"The minutes of the second trial were taken, but on examining them, we find no material facts relating to the prisoner, which are not presented on the first trial--we therefore think it unnecessary to copy them... Nelson Thayer was reserved for trial after his brothers in order to make use of the evidence of his (Nelson's) wife on their trial."--p. 10.
